Voyager Components, Inc. (“Creditor”) warranties goods sold to meet specifications as published by the manufacturer at the time of production, for form, fit and function, for a period of thirty (30) days from date of invoice. No further warranties, written or stated, express or implied, exist on goods sold. All claims for nonconformity related to form, fit and/or function of merchandise delivered must be made in writing by Customer within fifteen (15) business/working days ARO, not to exceed twenty eight (28) days from date of invoice. Customer shall therefore inspect all merchandise immediately upon delivery, and file any such claims with Creditor within the time prescribed.
Creditor's sole obligation shall be to replace or refund such merchandise, at the sole discretion of Creditor, which has been promptly reported as nonconforming by Customer, and which has been determined by Creditor to have been nonconforming. All other Customer returned merchandise will be subject to a restocking charge of up to twenty five (25) percent of its originally invoiced amount. Creditor reserves the right to refuse the return of any such merchandise. Creditor disclaims all other warranties expressed, implied or otherwise, and any claims of merchantability and/or fitness for a particular purpose. Creditor shall have no liability for any indirect, consequential, direct, or special damages to Customer with respect to Creditors obligations hereunder, including, but not limited to, loss of use, loss of profits, loss of business opportunities, or any other similar damages even if Creditor has been advised of the possibility of such damages. Creditor shall not be liable to Customer for any delay or failure by Creditor to perform its obligations herein.
